Maxwell Peter Hart: 43-year-old remains in custody after allegedly assaulting Five Star Yamaha worker

A man who destroyed a pair of motorcycles at Five Star Yamaha during a rampage through Hamilton Hill says he was responsible for the damage but did not assault an employee at the dealership. Maxwell Peter Hart, 43, remains in custody after two appearances via video link in Fremantle Magistrates Court in the past week. On Friday he pleaded guilty to seven criminal charges stemming from the January 17 incident. That day Hart stole gloves worth $75 and damaged two motorbikes at the dealership, one of which was worth $15,000 and the other $20,000. Hart also damaged a customer’s personal motorbike. Police have also charged Hart with assault of a retail worker, alleging the victim was an employee who tried to calm the situation inside Five Star Yamaha. After leaving the store, Hart smashed the window of a private property, damaged a coffee machine inside the nearby BP Spearwood, and stole $100 worth of electric cables and a key ring from the fuel station before leaving. Police charged Hart with two counts of stealing, four counts of criminal damage or destruction of property, one count of trespassing without a lawful excuse, and one count of assault on a retail worker who was performing their duties. Hart told Fremantle Magistrate Nicholas Lemmon he was not guilty of assaulting a retail worker after pleading guilty to all other charges. Mr Lemmon noted Hart’s guilty pleas on Friday and suggested he seek legal advice before being sentenced on Monday, February 3. On Monday, a duty lawyer requested that sentencing be adjourned. “I am going to adjourn the sentencing because I agree that it is a smart idea for Hart to receive extensive legal advice given the seriousness of his offending,” Mr Lemmon said. Hart is due to appear in Fremantle Magistrates Court via video link on March 10.
